Agreement to the terms
By accessing or using the SalesOps platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use SalesOps.
Eligibility and business use
SalesOps is intended for business use. You must be at least 18 years old and authorized to bind the organization on whose behalf you register. SalesOps is not a consumer service.
Account and users
The customer designates administrators who manage the workspace. Authorized Users must keep their credentials confidential and use SalesOps only within the scope granted by their administrator.
Subscriptions, trial, and billing
- SalesOps offers monthly and annual subscription plans.
- Eligible customers may receive a 14-day trial.
- Subscriptions renew automatically until cancelled.
- Fees are stated in the applicable order and may be exclusive of taxes.
- Late or failed payments may result in suspension.
Cancellation and refunds
Cancellation takes effect at the end of the current paid billing period; access normally continues until that period ends. Fees are generally non-refundable. Refunds may be considered in special circumstances at SalesOps' discretion. Enterprise agreements may contain different terms. Statutory consumer rights, where applicable, are not excluded.
Customer responsibilities
The customer is responsible for:
- Its Users, their access, and their conduct on SalesOps.
- Ensuring that emails, calls, texts, and other outreach conducted using SalesOps comply with applicable law (including CASL, CAN-SPAM, and GDPR marketing rules).
- Obtaining any employee notices or consents required in its jurisdiction for CRM, location, and AI-assisted features.
- The accuracy and legality of information entered into its workspace.
Acceptable use
You will not, and will not permit any User to:
- Use SalesOps for unlawful, harmful, or deceptive activity.
- Upload malware or attempt to disrupt or gain unauthorized access to the service.
- Reverse engineer the service except where legally permitted.
- Conduct security testing without prior written authorization.
- Use SalesOps to conduct continuous covert surveillance of employees.
- Upload sensitive information described as out of scope in our Privacy Policy.
- Rely on AI output as the sole basis for consequential decisions (hiring, firing, credit, insurance, medical, or legal decisions).
Customer data and licence
Customer content remains the customer's property. The customer grants SalesOps a limited licence to host, process, transmit, and display customer content solely to provide, secure, and improve the service as permitted by this agreement and the Privacy Policy. SalesOps may generate aggregated and de-identified information from the operation of the service in ways that cannot reasonably identify an individual or customer.
AI features
- AI outputs are generated automatically and may be incorrect, incomplete, or misleading.
- Users must review AI-generated content before relying on it.
- SalesOps does not guarantee business results, leads, revenue, conversions, route accuracy, or follow-up outcomes.
- AI output does not constitute legal, financial, medical, HR, or other professional advice.
- Customers remain responsible for lawful outreach and data use.
Third-party services
SalesOps integrates with third-party services. Use of those services is subject to their own terms and privacy notices. SalesOps is not responsible for third-party services outside its reasonable control.
Beta features
SalesOps may make preview or beta features available. These are provided "as is" and may be modified or discontinued without notice.
Availability and changes
SalesOps aims to keep the service available and secure. We may modify or discontinue features and perform scheduled maintenance. Enterprise SLA commitments apply only when included in a signed order form or enterprise agreement.
Suspension and termination
SalesOps may suspend or terminate access for material breach, non-payment, security risk, or legal requirement. Either party may terminate a subscription in accordance with its cancellation terms.
Data export and deletion
Authorized workspace administrators can export data. On termination, customer account information may be retained for up to one year subject to applicable legal obligations. See our forthcoming Data Retention and Deletion Policy for details.
Confidentiality
Each party will protect the other's confidential information using at least reasonable care and use it only to perform its obligations under this agreement.
Intellectual property
SalesOps and its licensors retain all rights in the platform, software, branding, and documentation. The customer retains rights in its customer content. Feedback provided to SalesOps may be used without restriction to improve the service.
Disclaimers
SalesOps is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, SalesOps disclaims all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade.
Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages. Aggregate liability arising out of or related to this agreement is limited to the amounts the customer paid to SalesOps for the service in the twelve months preceding the event giving rise to the claim. Enterprise exceptions may apply.
Indemnity
Each party will defend and indemnify the other against third-party claims to the extent required by an executed enterprise agreement or applicable law.
Governing law and disputes
This agreement is governed by the laws of Ontario, Canada, without regard to conflict-of-laws principles. The parties submit to the courts of Ontario, Canadafor disputes, subject to any applicable arbitration terms in a signed enterprise agreement.
Assignment and business transfer
SalesOps may assign this agreement in connection with a merger, acquisition, financing, reorganization, or sale of assets. The customer may not assign without SalesOps' prior written consent, except to an affiliate or a successor in interest by merger, acquisition, or sale of substantially all assets.
Force majeure
Neither party is liable for delays or failures caused by events beyond its reasonable control, including internet outages, third-party provider failures, and natural events.
Notices and misc.
Notices to SalesOps should be sent to info@salesops.ca. If any provision is unenforceable, the remainder will remain in effect. No waiver of any provision constitutes a waiver of any other. These Terms are the entire agreement between the parties concerning the subject matter, except where a signed enterprise agreement applies.
